Who we are

The Ultimate Business Playbook LLC (“we,” “us,” the “Service”) provides AI opportunity audits and related consulting. We are based at 82 Wendell Ave, Suite 100, Pittsfield, MA 01201, United States. For any privacy question, contact us at erika.ergart@theubp.com.

Information we collect

We collect only what we need to deliver the assessment, audit, and follow-up:

  • Assessment answers. When you take the conversational assessment, we store your responses, the resulting readiness score, and the contact details you provide (such as your name, email, business name, and team size).
  • Contact & booking details. Email address and any information you submit when booking a call or requesting the audit.
  • Interview content & recordings. During an engagement we conduct interviews that may be recorded and transcribed through a third-party meeting assistant (Fathom). See “Recordings and Massachusetts consent” below.
  • Usage data. Basic, privacy-friendly analytics about how pages are used (e.g. which pages are visited and whether the assessment is completed). Our analytics provider is configured to be cookieless and does not track you across other sites.

How we use your information

  • To generate and deliver your assessment results and audit deliverables.
  • To contact you about your results, scheduling, and the engagement.
  • To send follow-up emails you've opted into, which you can unsubscribe from at any time.
  • To operate, secure, and improve the Service.
  • To meet legal, accounting, and tax obligations.

We do not sell your personal information, and we do not share interview content with anyone outside the engagement. Employee interviews are treated as confidential and are not reported back to an employer verbatim.

Service providers we share data with

We use a small set of trusted vendors strictly to run the Service. Each processes data on our behalf under its own terms:

  • Hosting & analytics:Vercel (site hosting and privacy-friendly, cookieless analytics).
  • Database:Supabase (stores assessment answers, leads, and engagement records).
  • AI processing:our AI providers power the conversational assessment. Prompts and answers are processed to produce your results.
  • Meeting recording & transcription: Fathom. Fathom states it does not sell recordings or meeting content; we do not retain audio ourselves and work from the transcript and our notes.
  • Email:Resend (delivery of reports and follow-up emails).
  • Invoicing:Wave (billing and invoices).

Recordings and Massachusetts consent

Massachusetts is an all-party-consent state under the Massachusetts Wiretap Act (M.G.L. c. 272, § 99). Before any session is recorded, you are notified in advance. Fathom sends an email ahead of the meeting, and you may opt out of the audio recording at that point.

Note (internal, pending legal review): whether an advance opt-out email satisfies the affirmative all-party consent Massachusetts law requires (especially when interviewing a client's employees) is being confirmed with counsel. This section will be finalized based on that guidance.

Data retention

We keep assessment and engagement data only as long as needed for the purposes above or as required by law, then delete or anonymize it. You can ask us to delete your data at any time (see below).

Your choices and rights

  • Access, correct, or delete the personal information we hold about you.
  • Unsubscribe from follow-up emails using the link in any message.
  • Opt out of session recording when notified before a meeting.

To exercise any of these, email erika.ergart@theubp.com.

Security

We use reputable providers with encryption in transit and at rest and limit access to your data. No method of transmission or storage is perfectly secure, but we take reasonable measures to protect your information.

Children

The Service is intended for businesses and is not directed to anyone under 18.

Changes to this policy

We may update this policy as the Service evolves. We'll revise the “last updated” date above and, for material changes, take reasonable steps to notify you.
