Terms of Service

Last updated: October 20, 2026

Agreement

These Terms of Service (“Terms”) govern your access to and use of the website and services of The Ultimate Business Playbook LLC (“we,” “us”). By using the site, taking the assessment, or engaging our services, you agree to these Terms. If you don't agree, please don't use the Service.

The assessment and audit

The free assessment provides a general, automated readiness estimate. The paid audit is a professional consulting engagement scoped with you. Both are provided for your business and informational purposes.

Our deliverables, scores, and recommendations are informational and do not constitute legal, financial, tax, or investment advice. You are responsible for decisions you make based on them. Figures shown on the site are illustrative unless stated otherwise.

Fees and payment

Audit pricing is a flat fee by team size as described at the time of engagement (for example, $2,000, $5,000, or $10,000+). Specific scope, fees, and payment schedule are confirmed in your engagement agreement or invoice, which controls if it conflicts with these Terms. Invoices are due as stated on the invoice.

Scheduling and cancellation

Call and session scheduling, rescheduling, and cancellation follow the booking terms communicated when you book. Please give reasonable notice so time can be reallocated.

Confidentiality

We treat your business information and interview content as confidential and use it only to perform the engagement. Employee interviews are not reported back to an employer verbatim. We may be legally obligated to act if illegal activity is disclosed.

Your responsibilities

  • Provide accurate information and the access needed to perform the audit.
  • Ensure you have authority to share any business or employee information you provide.
  • Use the Service lawfully and not attempt to disrupt or reverse-engineer it.

Intellectual property

The site, its content, and our audit frameworks and methods remain our property. Upon full payment, you receive the rights to use the deliverables we prepare for your business as described in your engagement. You retain ownership of the information and materials you provide to us.

Third-party tools

The Service relies on third-party providers (such as hosting, database, AI, meeting recording, email, and invoicing vendors). Your use of the Service is also subject to those providers' terms, and we aren't responsible for their acts or omissions.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant any particular business outcome, revenue result, or savings from the assessment or audit.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to the Service will not exceed the fees you paid us for the engagement giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.

Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Disputes will be subject to the courts located in Massachusetts, unless your engagement agreement states otherwise.

Changes to these Terms

We may update these Terms as the Service evolves. We'll revise the “last updated” date above, and continued use after changes means you accept the updated Terms.
